Judge Issues Order Defining 'Impairment' in Silica Cases

CLEVELAND - A judge overseeing numerous silica claims in a state coordinated proceeding has issued an order to clarify and define the term 'impairment' as it is relates to language in a previous case management order. In Re All Silica Cases, No. 073958S (Ohio Comm. Pls., Cuyahoga Cty.).
Judge Francis E. Sweeney issued the order Oct. 17, commenting that it was in the 'best interest' of the Cuyahoga County Court of Common Pleas silica docket. Judge Sweeney also noted that the definition was necessary to assist the parties in 'fairly and efficiently preparing impaired silica cases for trial.'
