MDL Judge Picks 2 Duke Power Cases for Oct. 30 Trial

CLEVELAND -- The judge overseeing the Welding Fume Products MDL has picked two of the Duke Power cases to be consolidated for an upcoming trial slot. In re: Welding Fume Products Liability Litigation, MDL No. 1535 (N.D. Ohio).

The plaintiffs had moved to consolidate five cases for the Oct. 30 trial, but Judge Kathleen M. O'Malley of the U.S. District Court for the Northern District of Ohio opted instead in the Oct. 5 order to only include two of those cases for the upcoming trial.

Judge O'Malley consolidated Goforth (No. 06-17217) and Quinn (No. 06-17218) for the trial, and said …
