Defendants Seek to Exclude Evidence of Other Lawsuits in Upcoming Trial

JACKSON, Miss. - The defendants involved in an upcoming Mississippi trial have moved to exclude testimony, evidence or argument related to other claims and lawsuits, saying such evidence is hearsay and, therefore, inadmissible. Smith, et al. v. Lincoln Electric Co., et al. No. 05-001082 (Miss. Cir. Ct., Hinds Cty.).
Filed Sept. 15 in the Hinds County Circuit Court, the motion anticipates that plaintiff Troy Smith may seek to introduce testimony by other welders, as well as evidence pertaining to other claims involving the allegedly hazardous effects of welding fumes.
