ABERDEEN, Miss. - A former sandblaster who for several years before filing his silica lawsuit believed heavy smoking was to blame for his lung condition is not barred by the statute of limitations from pursuing his case, despite defense claims that silicosis was identified in old medical records as a possible cause his alleged injury, a state court judge has ruled. Riggle v. Pulmosan Safety Equipment Co., et al., No. 05-230 (Miss. Cir. Ct., Monroe Cty.).
