CLEVELAND - An Ohio appeals court has again dismissed the appeals of two doctors who claimed that a defense request for documents related to their X-ray screening practices was unduly burdensome and subject to privilege. Purdy, et al. v. Air Liquide America Corp., et al., No. CA 06 088418 (Ohio Ct. App., Eighth Dist.).
The Ohio Eight District Court of Appeals dismissed the appeal Aug. 16, after defendants argued that the trial court orders from which the doctors appealed were not final. Plaintiffs in the underlying silica case had also appealed the Cuyahoga County Court of Common Pleas decision denying …
