OAKLAND, Calif. - A defendant in a California silica case has asked the court to dismiss the plaintiff's claims for repeatedly failing to provide information about the case required under the court's case management order. Brown v. Lone Star Industries Inc., et al., No. RG05-210447 (Calif. Super. Ct., Alameda Cty.).

3M Co. filed the motion to dismiss Sept. 1 in Alameda County Superior Court, arguing that plaintiff Chester Brown's refusal to provide exposure and product identification information in the form of an initial disclosure demonstrates that his claims are baseless.
