High Court Dismisses Silica Claims Against Bacou-Dalloz

JACKSON, Miss. - The Mississippi Supreme Court has reversed a decision that allowed nearly 3,000 plaintiffs to pursue silica claims against a defendant they failed to correctly serve with their complaint until more than one year after it was filed. Bacou-Dalloz Safety, Inc. v. Thomas Hall, et al., No. 2005-IA-01095-SCT (Miss. Sup. Ct.).
In a decision dismissing the plaintiffs' claims against Bacou-Dalloz Safety Inc., the state high court said in its Sept. 7 decision that it could find no excusable reason why the plaintiffs waited so long to effect service of process on the defendant.
