Ohio Judge Chooses 100 MDL Cases to Begin Discovery Process

CLEVELAND - The judge presiding over the Welding Fume MDL has chosen 100 cases to begin medical record discovery, saying that the discovery should commence so that trial preparation can begin. In re: Welding Fume Product Liability Litigation. MDL No. 1535. Case No. 1:03-cv-17000 (N.D. Ohio).
In her Aug. 28 order, U.S. District Court for the Northern District of Ohio Judge Kathleen M. O'Malley chose 100 cases with a broad variety of diagnoses, filed by 19 different attorneys in 39 states. Of those 100 cases, 15 will eventually be chosen to begin case-specific discovery.
