CLEVELAND - Plaintiffs' counsel in Ohio have been ordered to disclose their inventories of cases that allege silica-related injuries so that they may be grouped and eventually set for trial. In re: All Silica Cases, No. 073958S (Ohio Comm. Pls., Cuyahoga Cty.).
Justice Francis E. Sweeney issued the order Nov. 27 in an effort to jumpstart the Cuyahoga County Common Pleas silica docket, which Judge Sweeney commented 'for months now ... moved nowhere.'
Defendants had filed a motion three weeks earlier, complaining that the silica docket was 'at a standstill' despite overdue deadlines for grouping cases under the court's October …
