EDWARDSVILLE, Ill. - An Illinois state court has granted a motion for a new trial in a welding fume case that ended in a defense verdict, determining that the defendants violated rules of discovery. Boren v. A.O. Smith Corp. No. 00-L-886 (Ill. 3rd Jud. Cir. Ct., Madison Cty.).
The Nov. 22 order from the Illinois 3rd Judicial Circuit Court for Madison County found that the defendants failed to provide complete discovery, specifically with regard to information given to the plaintiff about the defendants' key witness, Dr. Warren Olanow.
