BOSTON - The Massachusetts Court of Appeals has affirmed workers' compensation benefits for a man who claimed injury from exposure to beryllium dust but filed a late claim. In re Fantasia, No. 08-P-1494 (Mass. Ct. App.).

The court on Nov. 2 affirmed a decision by the Industrial Accident Reviewing Board for claimant Manuel Fantasia, ruling that the employer's insurer was not prejudiced by any delay.
