CLEVELAND - A sand supplier has been awarded summary judgment in a case set for trial later this month after the court determined that new evidence regarding the plaintiffs' knowledge of silica-related dangers may not extend the defendant's duty to warn of hazards about which the plaintiff was already aware. Pawlowski v. Best Sand Corp., No. 499457 (Ohio Comm. Pls., Cuyahoga Cty.).
Justice Francis E. Sweeney of the Cuyahoga County Court of Common Pleas issued the ruling Aug. 4, granting a renewed motion for summary judgment brought earlier this year by Best Sand Corp.
