Miss. High Court Reinstates Emergency Petitions in 2 Welding Fume Cases

JACKSON, Miss. -- The Mississippi Supreme Court has reinstated emergency petitions to appeal from an interlocutory order in two welding fume cases, according to a Jan. 11 list order released by the court. Caterpillar Inc. v. Troy Smith, No. 2006-M-01678-SCT (Miss. Sup. Ct.).

The petitions in the two cases, which are grouped with a third welding fume case, were dismissed in October as moot after the plaintiffs informed the court that the defendant filing the petition was voluntarily dismissed from the third case. However, no such dismissal ever took place in the remaining two cases, resulting in the reinstatement.
