Pulmosan to Appeal N.Y. Dissolution Ruling Allowing Texas Silica Claims

JAMAICA, N.Y. - Pulmosan Safety Equipment Corp. has filed a notice of appeal in New York, challenging a recent ruling that suspended their dissolution and allowed certain plaintiffs to sue the company for silica-related injuries. Ford v. Pulmosan Safety Equipment Corp., No. 8409/06 (N.Y. Supreme Ct., Queens Cty.).

The notice of appeal was filed Jan. 2 in the state's 2nd Appellate Division and in Queens County Supreme Court, where Judge Peter J. Kelly ruled on Oct. 25 that silica plaintiffs who can show that their claims against Pulmosan arose prior to 1986 may still assert claims against the defendant.
