Judge Refuses to Stay Case Pending Sophisticated User Appeal

CLEVELAND - A state court judge has denied an attempt by plaintiffs to halt a silica case while an appeals court determines whether a summary judgment decision in favor of defendants was correctly issued. Purdy, et al. v. Air Liquide America Corp., et al., No. 506483 (Ohio Comm. Pls., Cuyahoga Cty.).

Judge Francis E. Sweeney of the Cuyahoga County Common Pleas Court ruled June 1 that the case against the remaining defendants who were not awarded summary judgment earlier this year may proceed despite the pending appeal.
