CLEVELAND - Metropolitan Life Insurance Company has accused the MDL plaintiffs of "abandoning" their negligence and fraud claims against the company and replacing them with "misplaced" aiding and abetting and negligent undertaking claims. In re: Welding Fume Products Liability Litigation. MDL No. 1535. Case No. 1:03-cv-17000 (N.D. Ohio).
On May 31, Met Life replied to the plaintiffs' opposition to its omnibus motion for summary judgment, saying the plaintiffs' new theories are "misplaced" and "fail to raise any genuine issue of material fact."
