CLEVELAND -- Defendants involved in the next case scheduled for trial in the Welding Fume Products Liability Litigation MDL say they won't reference a study conducted by a Caterpillar expert. In re: Welding Fume Products Liability Litigation, MDL No. 1535 (N.D. Ohio).
In a May 11 e-mail that has since been entered in the U.S. District Court for the Northern District of Ohio docket, defense counsel David Landever of Weisman, Kennedy & Berris in Cleveland indicated the defendants plan to not 'have any expert reference and/or rely upon the Marsh (Caterpillar) study' for the purposes of the Solis trial.
