PHILADELPHIA - A Philadelphia judge has denied without prejudice a motion to transfer a silica personal injury claim to nearby Lancaster County. Horst v. U.S. Silica Co., No. 3542 (Pa. Comm. Pls., Philadelphia Cty.)
The order was issued Sept. 10, according to court sources. It followed a motion filed in Philadelphia Common Pleas Court by defendant Textron, Inc., Siebe North Inc. and Norton Co. Both were later joined by defendant 3M, which claimed that a transfer of venue was necessary because the plaintiffs have no ties to the Philadelphia County and because the court is already burdened with a backlog …
