OAKLAND, Calif. - A California judge has overruled a defense demurrer to a silica plaintiff's second amended complaint that named dozens of additional defendants and added claims for the plaintiff's alleged asbestos exposure. Bradley v. A-1 Aggregates, et al., No. RG05-214038 (Calif. Super. Ct., Alameda Cty.).
Alameda County Superior Court Judge Robert Freedman overruled the demurrer in an order issued April 28, rejecting allegations that the defendants were improperly joined and that the statute of limitations had expired on loss of consortium claims filed on behalf of the wife of Plaintiff Harold Bradley, who defendants said has re-filed or amended …
