CLEVELAND - State court judges in Ohio have awarded summary judgment to several silica defendants based on the sophisticated user doctrine. Purdy, et al. v. Air Liquide America, et al., Case Nos. 03-506483, 03-506484, 03-506486 (Ohio Comm. Pls. Ct., Cuyahoga Cty.).
The orders were handed down March 30 in cases filed in Cuyahoga County Court of Common Pleas by three foundry workers who claimed they developed silicosis as a result of exposure to silica dust. The cases were filed by the Cleveland-based law firm of Kelley & Ferraro, according to a court source.
