Defendants Say Landry's Case Should be Dismissed With Prejudice

CLEVELAND - Airgas Inc. and six other welding defendants said MDL plaintiff Scott Landry's case should be dismissed with prejudice because he is failing to prosecute his claims. Landry v. Nichols Wire Inc., et al. No. 1:03-cv-17016. MDL No. 1535 (N.D. Ohio).
Sources previously told HarrisMartin that Scott H. Landry is being replaced on the trial schedule by Ernesto Solis because of a personal problem. Landry's trial was scheduled for May 22.
On Dec. 16, Landry moved to dismiss his case without prejudice, saying he does not currently wish to prosecute his claims.
