MACON, Miss. - Defendants in two Mississippi silica cases involving nearly 4,500 claimants have asked a state court judge to issue sanctions of at least $330,000 against plaintiffs counsel for allegedly filing the claims, which they say are based on allegedly fraudulent diagnoses. Baldwin, et al. v. Graco Enterprises, et al., No. 2002-429 (Miss. Cir. Ct., Noxubee Cty.).
In motions filed Dec. 16 in Noxubee County Circuit Court, the defendants ask the court to carry forward the sanctions requested by federal MDL Judge Janis Graham Jack, who in June remanded the cases for lack of subject matter jurisdiction. In remanding …
