Defendants: Plaintiffs Trying to 'Rewrite History'




CLEVELAND - The welding fume MDL defendants said the plaintiffs are trying 'rewrite history' by moving to compel documents they did not request in the last discovery hearing. In re: Welding Fume Products Liability Litigation. MDL No. 1535. Case No. 1:03-cv-17000 (N.D. Ohio).

On Dec. 7, the defendants opposed a plaintiffs' motion for an MDL evidentiary ruling and to compel documents from all defendants, accusing the plaintiffs of not 'checking their facts.' They said the same Airco documents were not admissible in the Ruth case because the plaintiffs failed to prove that Airco is a predecessor to ESAB.
