ORANGE, Texas - Schramm Inc. has been awarded summary judgment in a Texas silica case for the second time in two weeks, after claiming it had no duty to warn sandblasters who allegedly used the company's air compressors to power their sandblasting equipment. Davis, et al. v. Minnesota Mining & Manufacturing, et al., No. 020518-C (Texas Dist. Ct., Orange Cty.).
Orange County District Court Judge Dennis Powell granted Schramm's motion Nov. 3, a little more than a week after a judge in Ohio awarded the defendant summary judgment on a nearly identical argument (See Article This Issue).
