Next MDL Case Scheduled for Trial Continued Until 2006

CLEVELAND -- The trial of an Alabama man has been continued until February 6 in what will be the first case in the MDL to proceed to trial, sources indicated to HarrisMartin. In re: Welding Fume Products Liability Litigation, MDL No. 1535 (N.D. Ohio).

The claims of Dewey Morgan were originally set in the U.S. District Court for the Northern District of Ohio for Nov. 15. Morgan was scheduled to be the second plaintiff to proceed to trial, following Charles M. Ruth III.

However, on Sept. 2, Ruth reached a seven-figure settlement with ESAB Group and Hobart Brothers. Welding Industry …
