CLEVELAND - 3M has successfully moved a trial court to clarify a recent opinion denying its motion for summary judgment based on the sophisticated user defense, after the silica defendant claimed the decision made certain statements regarding the 8710 dust mask that might be construed as determinations of fact. In Re: Jackson Group I Silica Cases, No. 469127 (Ohio Comm. Pls., Cuyahoga Cty.).
The Cuyahoga County Court of Common Pleas granted the motion to clarify its Aug. 3 ruling after 3M complained that the opinion went beyond denying the motion and included references that touched on factual and legal issues …
