Court Denies Defense Motion for Continuance; Trial Set for Nov. 28

GALVESTON, Texas -- A Texas judge has denied a defense motion for a continuance in an upcoming welding fume trial, sources told HarrisMartin. Montalbano, et al. v. Lincoln Electric, et al., No. n/a (Texas 56th Dist. Ct., Galveston Cty.).
Trial in the five-plaintiff lawsuit is scheduled to commence in the 56th District Court for Galveston County on Nov. 28.
In June, a federal court judge denied a defense motion for reconsideration of remand, after finding that the defendants failed to timely oppose the plaintiffs' motion to send the case back to state court.
