Mississippi Plaintiffs Seek Rule Changes, Mechanism for MedMon Silica Class Action

JACKSON, Miss. - Plaintiffs in cases that are slated to return to Mississippi from the silica MDL have filed a brief asking the Supreme Court to adopt new Rules of Procedure so that a medical monitoring class consisting of workers exposed to silica dust can be certified. In Re: Remanded Federal MDL Silica Products Liability Litigation, No. 2005-M-1356 (Miss. Sup. Ct.).
According to the July 29 filing, class action litigation may be the most efficient way of handling the claims of thousands of plaintiffs that have been remanded to Mississippi state court from MDL 1553.
