Plaintiffs Oppose Motion for Leave, Say Defendants Need to Identify ARCOS' Citizenship

CLEVELAND - The plaintiffs in the Welding Fume MDL on July 18 opposed a defense motion for leave, arguing that the defendants have not established federal diversity jurisdiction because they have not identified the members of ARCOS Industries. In re: Welding Fume Products Liability Litigation. No. 1:03-cv-17000. MDL Docket No. 1535. (N.D. Ohio.).
The plaintiffs urged the U.S. District Court for the Northern District of Ohio to require the removing defendants to submit affidavits identifying the citizenship of ARCOS Industries for the purposes of federal diversity jurisdiction.
