Plaintiffs Oppose Caterpillar's Demurrer, Points to Welding Rod MDL Decision

OAKLAND, Calif. -- Plaintiffs involved in the California coordinated welding product cases have asked the court to look to the Welding Rod Liability Litigation MDL in addressing a demurrer made by Caterpillar claiming it does not belong in the welding litigation. Welding Products Cases, JCCP No. 4368 (Calif. Super. Ct., Alameda Cty.).
The June 7 opposition to the demurrer, filed in the California Superior Court for Alameda County, says that the judge overseeing the MDL has already denied a similar motion made by Caterpillar in the federal proceedings.
