CLEVELAND - Plaintiffs in the Ohio silica litigation have fired back at claims made by 3M Co. that they failed to submit evidence that their injuries were caused by the company's allegedly defective respiratory product. Boyce v. 3M Company, et al., No. 469149 (Ohio Comm. Pls., Cuyahoga Cty.).
In a response to a 3M motion for summary judgment based on failure to establish medical causation and product defect, the plaintiffs argue that they have presented competent evidence showing that the 3M masks they used failed to protect them from inhaling dangerous amounts of silica dust.
