Mississippi Defendant Seeks Dismissal as Retail Seller

CLEVELAND -- B & R Industrial Supply has filed a motion to dismiss in four welding rod lawsuits currently pending in the Welding Rod Products Liability Litigation MDL, claiming that the company is a retail seller of industrial goods, therefore precluding claims against them. In re: Welding Rod Products Liability Litigation, MDL Docket No. 1535 (N.D. Ohio).

In an April 22 motion filed in the U.S. District Court for the Northern District of Ohio, B & R Industrial Supply asserted the 'Innocent Seller' Statute as the basis for seeking dismissal from the welding rod lawsuits.
