ATLANTA -- Two recent complaints are currently pending in federal court, one having been filed there, and the second one removed after defendants claimed that the plaintiffs worked on U.S. Navy ships. Payton, et al. v. Lincoln Electric, et al., No. 05-078 (N.D. Ga.); Crosby, et al. v. Lincoln Electric Co., et al., No. 05-253 (S.D. Miss.).
In an April 12 complaint filed in the U.S. District Court for the Northern District of Georgia, plaintiff Roger Payton claims that he has suffered severe physical and emotional injuries as a result of exposure to welding fumes.
