BIRMINGHAM, Ala. - A judge in Alabama has dismissed with prejudice claims against several defendants named in a silica complaint that was re-filed after another judge dismissed the suit for failure to comply with federal pleading requirements. Chancellor, et al. v. Air Liquide America Corp., et al., No. 04-3102 (N.D. Ala.).
In a Memorandum Opinion issued March 29, Judge R. David Proctor of the U.S. District Court for the Northern District of Alabama dismissed claims against nearly a half-dozen defendants after finding that the claims failed to state a claim upon which relief could be granted.
