LOS ANGELES - A defendant who recently removed a silica-related personal injury claim to federal court citing federal enclave jurisdiction has opted not to challenge an ex parte application to remand the action to state court. Mahar v. 3M Company, et al., No. 05-1657 (C.D. Calif.).
A stipulation and order to remand was entered by defendant 3M Co. on April 8 in the U.S. District Court for the Central District of California, effectively remanding the claims of Rick Mahar to the Los Angeles County Superior Court, where the case was filed in February.
