Texas High Court Denies Petition to Review Statute of Limitations Ruling

AUSTIN, Texas - The Texas Supreme Court has declined to review an appeals court decision that reversed a trial court's award of summary judgment to defendants in a silica case brought by a sandblaster who the defendants said failed to file his complaint within the applicable statute of limitations. U.S. Silica Company, et al. v. Youngblood, No. 04-0428 (Texas Sup. Ct.).
The high court on Jan. 21 denied a petition to review the appeals court ruling, which was challenged by defendants U.S. Silica Co., The Feldspar Corp. and Unimin Corp.
