NEW ORLEANS -- Defendants in a recently filed Louisiana welding rod lawsuit have moved to dismiss the plaintiff's fraud and conspiracy claims, arguing that they fail to meet specification requirements. Duchene v. A.O. Smith, et al., No. 04-3382 (E.D. La.).

In a motion filed Jan. 10 in the U.S. District Court for the Eastern District of Louisiana, defendants argued that plaintiff James Duchene's fraud and conspiracy claims fail because he does not assert when the fraud occurred and what exactly was withheld from the plaintiff.
