MDL Judge Issues Split Remand Order in Texas Welding Rod Lawsuits

CLEVELAND -- In her third remand order in two days, Judge Kathleen M. O'Malley has remanded a single-plaintiff Texas welding rod lawsuit, but maintained jurisdiction over a plaintiff recently severed from the suit. In re: Welding Rod Products Liability Litigation, MDL Docket No. 1535 (N.D. Ohio).
In a Jan. 13 order, Judge O'Malley of the U.S. District Court for the Northern District of Ohio found that evidence indicating that the severed plaintiff worked under guidelines provided by the federal government was undisputed.
