ODESSA, Texas - A state court judge in Texas has again rejected claims by a former sandblaster who alleged that the manufacturer of an air compressor had a duty to warn of silicosis hazards associated with using the product. Boone, et al. v. Aearo Company, et al., No. C-114,896 (Texas Dist. Ct., Ector Cty.).
Ector County District Court Judge W. Stacy Trotter issued the order awarding summary judgment to Schramm Inc. on Jan. 10. Judge Trotter's order marks the third time in six months that Schramm has been awarded summary judgment after claiming that it had no duty to warn …
