BOSTON -- Welding rod defendants have moved to stay a recently filed class action lawsuit, claiming that a stay would be in the best interests of judicial economy because the case could be transferred to the Welding Rod Products Liability Litigation MDL proceedings. Aceto v. Lincoln Electric, et al., No. 04-12740 (D. Mass.).
Originally filed Nov. 5 in the Massachusetts Middlesex Superior Court, the lawsuit purports to represent plaintiffs who have been injured as a result of exposure to manganese-containing welding fumes. Defendants removed the lawsuit on Dec. 30 to the U.S. District Court for the District of Massachusetts.
