MDL Defendants Move for Summary Judgment After 2nd Doctor Disclaims Diagnoses

CORPUS CHRISTI, Texas - Defendants in two multi-plaintiff silica cases have filed a second motion for summary judgment after another physician who allegedly diagnosed the plaintiffs with silicosis denied during deposition that he ever issued the findings. In Re: Silica Products Liability Litigation, MDL No. 1553 (S.D. Texas).

The motion was filed Dec. 22 in U.S. District Court for the Southern District of Texas, two days after the deposition of Dr. Glyn R. Hilbun revealed information indicating that the diagnoses of nearly 450 plaintiffs with silicosis claims pending in the MDL are fraudulent, according to the defendants.
