JACKSON, Miss. - 3M Co. has filed its appellant's brief in a dispute currently before the Mississippi Supreme Court over whether two trial court judges abused their discretion when they denied the defendant's motion to sever two multi-plaintiff silica cases. 3M Company, et al. v. Glass, et al., No. 2003-M-00617 (Miss. Sup. Ct.).
In a brief filed Nov. 22, 3M argues that recent case law and testimony from the plaintiffs themselves support severance of the claims because the plaintiffs failed to show that their alleged injuries arose out of the same occurrence or event. The defendant further contends that in …
