BALTIMORE -- An insurer has moved for summary judgment in an action it commenced against a welding rod defendant, claiming that policy language unambiguously precludes coverage for underlying actions alleging exposure to welding fumes. United States Fire Insurance Co. v. Clendenin Brothers Inc., et al., No. AMD03CV3308 (W.D. Md.).
U.S. Fire Insurance Co. filed the motion in the U.S. District Court for the Western District of Maryland on Dec. 13, contending that asbestos exclusions bar the defendant from defense or indemnity against allegations of asbestos exposure asserted in the welding rod lawsuits.
