EDWARDSVILLE, Ill. - Defendant Lockheed Martin has moved to dismiss a silica complaint filed in Illinois on forum non conveniens grounds after the plaintiff's discovery responses revealed that his claims have more in common with Wisconsin than with the venue where it is currently pending. Dille v. American Optical Corp., et al., No. 03-L-1888 (Ill. Cir. Ct., Madison Cty.).
Lockheed filed its motion Nov. 30 in Madison County Circuit Court, alleging that plaintiff Gary Dille's decision to file his case there constituted 'nothing more than outright forum shopping.'
