GALVESTON, Texas - A defendant in a Texas silica lawsuit has responded to a motion to exclude the company's experts, arguing that the plaintiffs are attempting to shift the burden to defendants to show that its product did not cause the plaintiff's alleged silica-related injury. Wolfe, et al. v. Air Liquide America Corp., et al., No. 03-CV-0537 (Texas Dist. Ct., Galveston Cty.).
U.S. Silica filed the response on Dec. 6 in the Galveston County District Court, where plaintiff Kenneth Wolfe has sued the company and several others for allegedly causing his silicosis and scleroderma.
