CLEVELAND -- An estimated 2,400 plaintiffs have moved to remand their claims from the federal court presiding over the welding rod MDL, arguing that defendants removed their lawsuit beyond the 30-day removal time limit. In Re: Welding Rod Products Liability Litigation, MDL No. 1535 (N.D. Ohio).

The plaintiffs' Nov. 29 motion filed in the U.S. District Court for the Northern District of Ohio also claims that federal defenses asserted by the defendants in their removal notice fail because the defendants concealed information regarding welding rod fume dangers, thus precluding the government from exercising discretion over the warnings attached to the …
