CLEVELAND -- Mississippi plaintiffs with claims pending in the welding rod product liability litigation MDL have moved to remand, arguing that the defendants' reliance on the government contractor defense and the Defense Production Act in removing the lawsuits fail. In re: Welding Rod Products Liability Litigation, MDL Docket No. 1553 (N.D. Ohio).
In a Nov. 18 brief filed in the U.S. District Court for the Northern District of Ohio, the plaintiffs in eight Mississippi welding rod lawsuits additionally argued that the lawsuits do not fraudulently join certain defendants.
