CHICAGO -- An Illinois judge has dismissed without prejudice the claims of three consolidated welding rod lawsuits, ruling that the plaintiffs cannot assert causes of action solely grounded in the fact that defendants took part in trade associations. McCaffery v. A.O. Smith, et al., No. 03 L 7709 (Ill. Cir. Ct., Cook Cty.).
In an order signed Oct. 7, Judge Jennifer Duncan-Brice of the Illinois Circuit Court for Cook County dismissed the claims of plaintiffs in McCaffery, Bollato, and Samborski, after finding that the majority of the claims asserted by the plaintiffs did not contain sufficient facts, and that other …
