JACKSON, Miss. -- Defendants in a Mississippi welding rod case have filed a petition for interlocutory appeal, asking the state's highest court to reconsider the denial of its motion to transfer venue. Lincoln Electric, et al. v. Blackmon, No. 2004-M-01896-SCT (Miss. Sup. Ct.).
In the Sept. 24 petition filed in the Mississippi Supreme Court, defendants claim that plaintiff Joe Blackmon's lawsuit erroneously remains in Holmes County Circuit Court, despite the fact that that the plaintiff filed homestead exemptions in Carroll County in the years before and after the lawsuit was filed.
