AUSTIN, Texas - Plaintiffs opposing a petition to review an appeals court ruling that reversed an award of summary judgment to defendants in a silica case have filed a brief in the Texas Supreme Court, claiming that the high court doesn't have jurisdiction to hear the case because the appeals court's decision is not at odds with any precedent set by the state's courts.
